Passenger takes British Airways to Court for alleged missing carry-on luggage

The Federal High Court in Abuja has fixed July 2 for the continuation of hearing in a suit filed by passenger Amechi Michael against British Airways for an allegedly missing carry-on bag.

At Friday’s resumed hearing, Michael told the court he reported the incident to the airline’s customer care service and was referred to the UK-based Centre for Effective Dispute Resolution. An arbitrator later awarded him compensation for a delayed flight but did not address the missing luggage.

Dissatisfied with the outcome, Michael rejected the arbitral award and filed suit before the Federal High Court in Abuja seeking redress.

The passenger said a cabin crew member requested that his bag be handed over for safekeeping during a delayed boarding process, with assurances it would be returned on arrival.

According to court filings, the luggage was never returned despite repeated complaints to the airline.

Michael argued that British Airways owed him a duty of care and alleged negligence by airline staff in handling the bag.

Counsel to the plaintiff, Abiola Olaitan and Shuaib O. Hammed of Parvina Partners, informed the court of their intention to close the plaintiff’s case after cross-examination by defence counsel John Godwin, who held the brief of SAN Folorunsho Majiyagbe.

Justice Obiora Egwuatu adjourned the matter to July 2 for the defence to open its case.

The suit, marked FHC/ABJ/CS/1293/2025, seeks the recovery of the carry-on luggage allegedly lost while in the airline’s custody.

The case adds to a growing number of claims by Nigerian air travellers over lost baggage, delayed flights, and airline accountability in the international aviation sector.
