In the ongoing case related to the $9.6 billion P&ID fraud, the Economic and Financ ial Crimes Commission (EFCC) continued to bolster its case on Monday, March 11, 2024, by presenting additional evidence against MICAD Project City Services Limited and James Nolan before Justice Obiora Egwuatu of the Federal Capital Territory High Court, Abuja.
MICAD Project City Services Limited and James Nolan face a 20-count charge including obtaining by false pretence, non-compliance with the Money Laundering Act 2011 (as amended), and criminal conversion of proceeds of crime totaling N151,394,328.00 (One Hundred and Fifty-one Million, Three Hundred and Ninety-four Thousand, Three Hundred and Twenty-eight Naira).
During Monday’s court session, the prosecution counsel, Bala Sanga, informed the court that the EFCC had filed additional evidence on February 20, 2024.
The defence counsel, Micheal Ajara, confirmed they had received the evidence.
To support their case, Sanga presented the third prosecution witness, Nnedimma Irene Eyisi, a lawyer.
Eyisi recounted how James Nolan had approached her in 2016 to facilitate his renewal as the Director of MICAD.
She stated, “In 2016, I was approached by James Nolan to assist in renewing his directorship at MICAD. After receiving necessary details, I prepared the required documents, including a CAC Form 7, for the directors’ signatures.”
Eyisi continued, “Subsequently, I received signed documents from the relevant parties, processed them with the Corporate Affairs Commission (CAC), and ensured the necessary payments were made. Upon approval, I collected the Certified True Copies (CTC) of the documents and notified Mr. Nolan.”
Eyisi also mentioned her interaction with the EFCC regarding the matter, providing a statement on August 31, 2021, which was subsequently submitted as evidence.
The defence did not contest the admission of this document.
Justice Egwuatu admitted the document as Exhibit J and scheduled further proceedings for March 12, 2024.
In previous hearings on January 18, 2024, the prosecution’s second counsel, Hussain Babangida, had highlighted how directors of Micad City Services Ltd had absconded with approximately N39,450,224.23 owed as taxes to the Federal government using falsified signatures.
