Tinubu to S’Court: Atiku’s appeal is “abusive”, liable to dismissal

President Bola Tinubu has asked the Supreme Court to dismiss the appeal filed by former Atiku Abubakar and the Peoples Democratic Party (PDP) challenging his victory in the 2023 presidential election.

Tinubu described Atiku and PDP’s appeal as abusive in nature.

Tinubu, who claimed that Atiku, former Vice President and his party failed to prove all their allegations and submissions at the Tribunal, maintained that Presidential Election Petition Tribunal (PEPT), was right in arriving at its verdict on September 6, where it dismissed their petition and affirmed the President’s victory.

He urged the apex court to act in like manner by not only dismissing the appeal for lacking in merit and bona fide, but also affirm his victory.

Atiku and the PDP had filed their petition challenging the outcome of the presidential election which was held on February 25, 2023.

They alleged that the election was marred with irregularities and substantial non-compliance with the Electoral Act.

They also alleged that Tinubu and Vice President, Kashim Shettima were not qualified to contest and that they did not win the election by the majority of lawful votes cast.

Following the dismissal of the case at the lower court, made up of judges of the Court of Appeal, who sat as PEPT, Atiku and the PDP, had moved to the apex court on September 18, 2023, where they filed a 35-ground appeal, complaining that Justice Haruna Tsamanni, who headed the five-man panel of PEPT and his team committed “grave errors and gross misrepresentation” which resulted in a miscarriage of justice, which needed to be remedied.
