Supreme Court reserves judgement in ADC leadership tussle as David Mark fights appeal

The Supreme Court on Wednesday reserved judgement in the African Democratic Congress [ADC] leadership dispute after hearing an appeal filed by former Senate President David Mark.

A five-member panel led by Justice Mohammed Garba adjourned for judgement after parties adopted their final written addresses.

Mark, who leads one of the ADC factions, is challenging a March 12 Court of Appeal ruling that ordered all sides to maintain the status quo pending resolution of the crisis.

He argues the appellate court overreached because the dispute is an internal party matter outside judicial intervention.

The suit was filed by aggrieved members led by Nafiu Bala Gombe, who are contesting the legitimacy of Mark’s leadership.

Other respondents are the ADC, National Secretary Rauf Aregbesola, the Independent National Electoral Commission, and former national chairman Ralph Nwosu.

Mark wants the court to restrain INEC from recognising any leadership besides his faction until the appeal is decided.

The respondents asked the Supreme Court to dismiss the appeal.

They argue the Court of Appeal acted within its jurisdiction.

INEC has withheld recognition of any faction and removed the names of the rival leaders from its official portal pending the outcome.
