▪︎Says the Court denied Kelvin Uyi Martins fair hearing
The last has not been heard of the intriguing matter between Kelvin Uyi Martins and Sandra Palmer Agho, as the former’s lawyer has filed a Notice of Appeal at the Court of Appeal, in Benin City.
He is seeking to set aside the ex parte order granted by the Hon Justice Peter Akinhiero in High Court No 6, Benin City, saying the order was granted without jurisdiction

He said the court closed its eyes to the many discrepancies in the affidavit in support and the documents attached including the one that her name on many documents attached to the motion ex parte is “Sandra Palmer Agho” and not “Sandra Palmer Martins”, which she used to initiate the proceedings as she does not have an official identification as Sandra Palmer Martins.
Rather, all her identifications, including her International Passport, carry the name “Sandra Palmer Agho”.
The Lawyer is seeking an order setting aside the ex parte order and reverting the case to another judge for hearing and determination.
The 11 grounds of appeal included the fact the the judge gave an order over a matter that the main actor -Kelvin Uyi Martins- is not a party, and raised over 30 particulars of errors which promise to enrich the jurisprudence of Nigerian Law.
Recall that in the Edo child tango, a report by the Interpol had vindicated Kelvin Uyi Martins, noting that allegations against him by Sandra Palmer Agho were false
A Certified True Copy of the International Criminal Police Organisation Report dated 27th June, 2022, with Reference No. AB:4099/x/ICPOL/LOS/VCP/3142, signed by the then Deputy Commissioner of Police IINTERPOL, Force CID Annex, Alagbon Close Ikoyi Lagos, DCP Martin Nwogoh had reinforced the truth of the case between Sandra Palmer Agho and a Danish of Nigeria Descent -Kelvin Martins over their child.
The report had essentially shown that the allegations by Sandra Palmer Agho, which have been in the media, were not true .
The report, which was based on a petition by Sandra Palmer Agho, filed by her Lawyers -Obasuyi & Obasuyi- in a petition dated 22nd June, 2022, entitled: “CASE OF ABDUCTION. THREAT TO LIFE AND CONDUCT LIKELY TO CAUSE BREACH OF THE PEACE AGAINST ONE KELVIN UYI MARTIN” calling for the investigation of the allegations as stated supra against Kelvin Uyi Martins, said in its findings, based on the report of the Danish Branch of INTERPOL, among others, as follows :
▪︎That Johannes Owen martins is confirmed to be registered in the Danish police system as a child of Sandra Palmer Agho { mother ) and kelvin uyi martins ( Father)
▪︎That on interrogation of kelvin Uyi Martins by the Danish police authorities, he confirmed that he had sex with Sandra Palmer Agho in Nigeria while on holiday, which resulted in the birth of Johannes Owen Martins in year 2019.
▪︎That Sandra Palmer handed over custody of her son Johannes Owen Martins to kelvin Uyi Martins and requested that he be taken to Denmark
▪︎That kelvin Owen Martins had at several times offered Sandra the opportunity to come to Denmark to see her son and she had wanted to take Johannes instead
▪︎That a Danish international passport has been obtained for Johannes Owen Martins and the Danish police authority confirmed that he was healthy and well, seems to be happy without any signs of dissatisfaction
▪︎That the apartment where Johannes and kelvin resides was confirm to be neat and tidy, that it was not characterised by any kind of dissatisfaction
▪︎That kelvin stated that johannes was already attending Danish school and has started speaking Danish.
▪︎That kelvin Uyi Martins is married in Denmark and Sandra is aware of which of this fact though his wife gave consent to having sex with Sandra while in Nigeria.
▪︎That a DNA test confirmed that johannes Owen Martins is the son of kelvin Uyi Martins and Sandra Palmer Agho. And that he always sent the pictures of Johannes to Sandra and were always speaking on phone and on via video calls.
▪︎That the wife of kelvin in Denmark, Afhane took ill and later died as a result of the sickness what was okay with Sandra coming over to Denmark as they were all friends and had pictures together but Sandra declined.
