A High Court in Awka has declined to renew an order it granted embattled Senator Ugochukwu Uba on July 5, 2021, seeking the disqualification of Mr Valentine Ozigbo as the candidate of the Peoples Democratic Party (PDP) in Anambra state.
The crux of the suit was for the court to withdraw legal recognition for Ozigbo’s Governorship candidature.
The said order, initially granted by Justice Obiora A. Nwabunike, going by Order 40, Rule 3(3) of the High Court Civil Procedure Rules was only ex parte and could only subsist for seven days after which the Court may choose to renew it or it would stand abated in consequence.
The Court, on Monday, refused to renew the order and was thus vacated.
The order had restrained “the Peoples Democratic Party from presenting, receiving, parading or accepting Ozigbo as the authentic Governorship Candidate for Anambra State.”
Ozigbo remains, in the eyes of the law, the recognised PDP Candidate for the November 6 Anambra Governorship election.
