Court Orders Globus Bank to pay Haril Global N256m for breach of contract

An FCT High Court sitting in Apo has ordered Globus Bank Ltd to pay Haril Global Solutions Ltd N256 million for breach of contract and wrongful deductions.

Justice Christopher Oba delivered the judgment on May 11, 2026, in suit FCT/HC/CV/1456/2026. The court found that the bank breached a valid overdraft facility agreement dated July 4, 2023.

The judge ordered the bank to refund N109 million withdrawn from Haril Global’s Debt Service Reserve Account on Dec. 29, 2023, and transferred to its overdraft account contrary to the agreement.

The court also directed Globus Bank to return N26.08 million withdrawn on Jan. 31, 2024, and N15 million withdrawn on Feb. 6, 2024, as interest, noting that a Post-No-Debit restriction had already been placed on the account.

In addition, the bank was ordered to pay N5 million in general damages for breach of contract and N1 million as cost of the suit.

Justice Oba declared that the contract between the parties was discharged by the bank’s breach and that Globus Bank was liable for damages.

The court dismissed the bank’s counter-claim alleging fraud and unlawful interference by Haril Global. Justice Oba said the bank failed to provide credible evidence, and that a police investigation report cited by the bank did not indict the claimant.

“The Counter-Claimant has failed to discharge both the legal and evidential burden of proof required by law,” the judge ruled.

The counter-claim was dismissed in its entirety for lack of merit.
