Legal battle opens as Peter Obi files a petition challenging result of 2023 presidential election

The presidential standard-bearer of the Labour Party (LP) in the February 25, 2023, election, Mr Peter Obi has now filed his petition challenging the Independent National Electoral Commission’s (INEC’s) declaration of Ahmed Bola Tinubu of the All Progressives Congress (APC) as winner of the presidential polls.

Mr Obi’s legal team had been having a running battle with INEC over the release of electoral materials used for the election for the inspection by the team as ordered by the Court to enable the lawyers file their case.

At some point, it was reported that INEC had allowed access to only the electoral materials from two out of the nine states of the federation, which the legal team specifically implicated.

It would have asked for more states, but for the shortness of time within which to file its processes.

Despite requesting for only nine States that were critical for strengthening the weight of evidence in finger its case, the INEC had reportedly frustrated its inspection as it could only access two states as of last week.

By filing the petition on Tuesday, it did appear as of press time, that the legal team has successfully accessed the remaining seven states whose electiral materials it requested to inspect.

THE CONCLAVE reports that a tweet by Dr Yunusa Tanko, Chief Spokesperson of the LP- PCC, said the team had been able to file Obi’s petition at the Tribunal to kickstart what many Nigerians see as the battle to retrieve the Obi/Datti mandate.

Dr Yunusa Tanko said: “It is official: the Labor Party Presidential candidate, Peter OBI, has filed his petition to the presidential elections tribunal in Abuja. The process of reclaiming the people’s mandate has started. Dr Yunusa Tanko Chief Spokesperson LP- PCC.”
