A High Court sitting in Benin has awarded the sum of 10 million naira to Jenifer Adun as compensation for the inhuman treatment meted out to her by some persons who called themselves “big boys” who were respondents in the case.
The court ordered the respondents to remove forthwith the said viral video from all forms of social media immediately and pay the applicant the sum of 10m within 30 days from 25th February, 2022.
The presiding Judge, Hon. Justice Courage Ogbebor awarded the sum of 10 million Naira as compensation to the applicant (Jennifer Adun).
Jennifer Adun was 18 years when she was taken to Litmus Suit & Hotel by some so called Big Boys in 2018 who claimed she stole the 1st respondent’s Iphone 7 and was taken to their home for three days where she was locked her up, stripped completely naked, with her two hands tied behind her and a tyre put round her neck amid threats to burn her alive.
They reportedly made video recording of her and circulated the video on several social media platforms.
The applicant who was represented by the law Firm of West-Idahosa & Co., (SAN) filed a suit to enforce her fundamental human rights.
On behalf of Adun, the Law firm argued that the act of the respondents amounted to a breach of her fundamental rights as enshrined in sections 34, 35 and 46 of the 1999 constitution (as amended) and urged the court to award the cost of N100 million in favour of the applicant for the emotional and psychological trauma that the applicant went through in the hands of the respondents.
After taking arguments from counsel to both parties and watching the viral video in open Court, the trial Judge delivered her judgment on 25th February, 2022 and ruled in favour of the applicant.
The court awarded the sum of N10 million as damages and ordered the immidiate removal of the said viral video from all forms of social media.
The court also ordered that the damages awarded should be paid to the applicant within 30 days.
